General ticket conditions of the Schwalbenschwanz Lounge
1. Scope of application
1.1 These General Ticket Terms and Conditions (ATGB) apply to the purchase and use of tickets and VIP packages for the Schwalbenschwanz Lounge at the Nürburgring. The contractual partner is Andreas Voos, acting under the name RingSpirit Events, Finkenweg 24, 53424 Remagen, Germany (hereinafter RingSpirit Events). RingSpirit Events operates the lounge and sells the booked VIP packages, including the included race track access, in its own name and on its own account.
1.2 The ATGB apply to bookings made through the official sales channels, in particular the ticket shop and individual bookings by email. They apply to consumers and entrepreneurs. Individual contract terms take precedence.
1.3 The motorsport competition is organized by an independent race organizer; the operation of the Nürburgring grounds is carried out by third parties. RingSpirit Events remains responsible to the customer for the contractually agreed components of the VIP package. The access, house and safety rules of the race organizer and the grounds operator made available before the conclusion of the contract must be observed in addition. These do not limit claims against RingSpirit Events arising from the booked package.
2. Ticket booking and contract conclusion
2.1 Tickets can be purchased through the official sales channels announced by the organizer for the respective event. There is no guarantee of availability for certain tickets, seats, or categories.
2.2 In the case of online orders, the customer submits a binding contractual offer by activating the order button clearly marked as payment-related. Prior to that, entries can be checked and corrected. RingSpirit Events accepts the order by means of an explicit booking confirmation, a payment request, or the sending of the tickets. An automated message solely confirming receipt does not constitute acceptance. If no acceptance is received within five calendar days, the customer is no longer bound by their offer.
2.3 In individual bookings made by email, the contract is concluded upon acceptance of a binding offer within the specified validity period. If the offer is described as non-binding, the customer’s order constitutes the contractual offer, which RingSpirit Events accepts by booking confirmation. The ATGB will be made available to the customer before the submission of their binding declaration. The contractual language is German, unless otherwise agreed in individual cases. The contractual content and the ATGB will be confirmed to the customer on a durable data carrier, in particular by email; a customer account is not required to secure these documents.
2.4 The organizer may limit the number of tickets per order. Orders made through automated procedures to circumvent such restrictions or under deliberately false identity information may be rejected or cancelled to the extent permitted by law.
2.5 The admission tickets and the documents included in the booked package are generally sent by post to the specified shipping address. For short-notice bookings, a different delivery method may be agreed upon before the contract is concluded, particularly pick-up or digital transmission. Any shipping costs will be indicated before the contract is concluded. The delivery deadlines are determined in accordance with paragraph 7.2.
2.6 The customer must verify the accuracy of their order and contact details and notify any changes to the shipping address in a timely manner. Any electronic tickets must be legible upon entry. Statutory claims remain unaffected.
3. Tickets and right of access
3.1 A valid ticket entitles a person to access the Swallows’ Neck Lounge on the booked days within the agreed opening hours and to use the services included in the booked package. Four-day tickets are valid from Thursday to Sunday; day tickets are valid for the booked day. The race track access included in the package applies to the confirmed days and areas.
3.2 Upon entry, valid admission credentials must be presented. If a control wristband or comparable proof of admission is issued, it must be shown during the stay and upon re-entry. For discounted tickets, appropriate proof of age may be required.
3.3 Leaving the lounge and re-entering it are permitted within the validity period of the ticket during the agreed opening hours with valid access credentials. A ticket does not entitle multiple persons to use it simultaneously. In addition, the control rules communicated to the race organizer or venue operator before the contract was concluded apply to re-entry into race track areas.
3.4 The VIP packages include lounge access, catering and beverages during the service times specified for these purposes, as well as entrance to the race track with access to the promised stands and driver's camps. The package includes the shuttle service in accordance with paragraph 9.4. A parking space is included per four booked tickets in accordance with paragraph 9.4. Additional services, such as special guided tours, program events, advertising services, or special transfers, are included in the contract if they are specified in the performance description applicable at the time of booking or individually agreed upon. Exclusive use of the lounge or a specific seat is only due upon express agreement.
4. Discounts and youth protection
4.1 Children up to and including six years receive the offered VIP day ticket free of charge. For children aged seven to twelve years, the offered child prices apply to VIP day and four-day tickets. After the age of 13, the regular ticket price applies. For day tickets, the age on the booked visit day and for four-day tickets the age on the first day of validity are decisive. A corresponding booking or admission entitlement is also required for a free visit.
4.2 Suitable proof of age may be required upon entry. If the conditions for the discounted fare booked are not met, the difference between the price of the ticket and the applicable fare may be refunded. Before denying entry, the customer must be given the opportunity to prove their eligibility or to make the required additional payment, insofar as this is possible and reasonable from an organizational perspective. Statutory claims remain unaffected.
4.3 The statutory youth protection regulations as well as the age and accompanying regulations communicated to you before the conclusion of the contract apply. The booking does not grant RingSpirit Events the right to assume parental responsibility for minors. Statutory traffic safety and protection obligations remain unaffected.
5. Awards and payment terms
5.1 The prices communicated before the contract was concluded apply. For consumers, the prices indicated are total prices including statutory sales tax and all mandatory price components. Optional additional services and any shipping costs are indicated separately before the contract is concluded. In offers exclusively directed at entrepreneurs, prices may be explicitly stated as net prices plus statutory sales tax.
5.2 The total amount for the booked tickets and agreed additional services must be paid in full in advance immediately after the contract is concluded and the invoice is received, unless expressly agreed otherwise. The payment methods offered at the time of booking or individually agreed shall apply. Tickets will be dispatched or made available after full payment has been received within the period specified in paragraph 7.2. Statutory rights of refusal and retention of title remain unaffected.
5.3 If a payment is missed for reasons attributable to the customer, legal measures permitted by law may be taken after a reasonable period has expired without success, including withdrawal and ticket suspension. Legal claims remain unaffected.
6. Right of withdrawal
6.1 For the tickets and VIP packages offered here for a specific event date or period, there is no statutory right of withdrawal in consumer contracts pursuant to § 312g, paragraph 2, no. 9 of the German Civil Code (BGB), as these are services related to leisure activities.
6.2 A voluntary right to cancel or change the booking exists only if this has been expressly agreed upon. The permitted transfer in accordance with paragraph 8 remains possible. Statutory rights of withdrawal, termination, reduction and reimbursement, in particular in the event of default or non-contractual performance, remain unaffected.
7. Complaints, loss, relocation and cancellation
7.1 The customer must report any obvious errors or discrepancies in the ticket to the contact address in paragraph 11 immediately upon receipt. This does not affect statutory warranty claims or other claims.
7.2 The admission tickets and any welcome packages included in the package will be sent three to four weeks before the event begins, provided that the booking and the full payment have been received by the start of this shipping period. In the case of later booking or later payment, the shipping will be made in time before the event; if timely delivery can no longer be guaranteed, a timely alternative arrangement will be agreed with the customer. In the event of non-delivery, loss or damage, the customer may contact the contact address in paragraph 11. A reported loss does not automatically result in the loss of the contractual performance claim. Statutory rights remain unaffected.
7.3 If the entire booked VIP package cannot be provided, refunds and further claims shall be governed by the statutory regulations. If the entitlement to compensation is therefore extinguished, any payments already made will be refunded, including the fees that are legally required to be reimbursed. In the event of a failure of individual package components, the statutory claims shall be determined based on the relevant service and its significance for the overall package. This also applies in the event of force majeure or government measures; a lack of fault does not automatically exclude reimbursement claims.
7.4 RingSpirit Events immediately informs customers of any cancellation or relocation of the event upon becoming aware of it. A replacement date is not binding solely on this ATGB. Changes to the race schedule, race cancellations, and road closures are to be distinguished from a failure of the lounge service. Since access to the race track is part of the VIP package, statutory claims due to affected package services remain in effect. Whether and to what extent a cancellation or refund is possible depends on the agreed scope of services and the statutory regulations.
7.5 In the event of the cancellation of an event that has already begun, claims are governed by the legal provisions and the specific circumstances, in particular the extent of the services already provided and any liability of the organizer.
7.6 Any necessary changes in space due to safety, regulatory, or organizational reasons will be made as equally as possible. Statutory rights of reduction, withdrawal, and reimbursement remain unaffected.
7.7 Travel, accommodation and other incidental costs are reimbursed in accordance with the statutory liability regulations; no further lump-sum reimbursement is guaranteed.
8. Transfer and unauthorized ticket sales
8.1 The purchase of tickets for commercial resale without the consent of the organizer is prohibited, insofar as this can be agreed upon in individual cases in a legally permissible manner. The use of bots to circumvent known ticket restrictions is not permitted.
8.2 Tickets are generally not personal in nature and may be passed on privately. The access permissions included in the package may be transferred only to the extent that they are still valid and transferable; the age requirements for discounted tickets also apply to the new user. A wristband issued for personal entry control may not be passed on to circumvent the entry control. The right to fully transfer an unused ticket remains unaffected by this.
8.3 Companies may use booked tickets without additional consent for the invitation of their own employees, customers, and business partners. The commercial resale and the independent commercial marketing of the tickets in external hospitality, travel, or other sales packages require the prior consent of RingSpirit Events. The same applies to public advertising campaigns and prize draws with the tickets. Advertising appearances, branding, and sponsorship in or at the lounge are permitted only to the extent expressly agreed upon; third-party rights and approvals remain to be observed.
8.4 In the event of intentional and significant violations of the above regulations, tickets involved may be suspended in accordance with legal requirements, further sales may be denied, and legal claims may be asserted. Where necessary, prior opportunity to remedy the situation must be provided. Whether a refund is due depends on the legal regulations. A lump-sum contractual penalty is not agreed upon.
9. Entrance, security, house rules and recordings
9.1 Access to the Schwalbenschwanz Lounge and the included Nürburgring areas requires the applicable admission permit at all times. The lounge opening hours and catering times will be communicated to the customer before the conclusion of the contract and are part of the service description. There is no obligation to operate the lounge 24 hours a day. Legal house and safety regulations as well as the additional rules of the race organizer and the ground operator must be observed. Legal rights regarding changes to promised services remain unaffected.
9.2 Appropriate security checks may be carried out in accordance with legal regulations. Those who refuse a legally required check may be excluded from entry, provided that the legal requirements are met.
9.3 Weapons, pyrotechnics and other dangerous or prohibited items according to the applicable house rules are not permitted to be brought into the lounge. Dogs are generally not allowed in the lounge. Assistive dogs, especially guide dogs for the blind, are exempt from this to the extent legally provided.
9.4 For every four booked tickets, one parking space is included; for eight tickets, two parking spaces are included. Additional parking spaces agreed upon individually remain unaffected. The parking space allocation and access information will be communicated with the booking or event documents. The shuttle service is included in the VIP package for the booked days. Departure points, routes served, and operating times will be communicated in the performance description before contract conclusion. Traffic-related waiting times are possible. Special restrictions, particularly on Sundays due to the departure traffic, will be specifically announced before contract conclusion. This arrangement does not constitute a claim for an individual transfer outside the agreed services and operating times. Statutory claims in the event of failure or significant changes to promised services remain unaffected.
9.5 Private photo and video recordings are permitted only insofar as third-party rights as well as the terms and conditions of the motorsport event organizer and the respective areas are respected. Commercial recordings, live streams and media productions require the necessary approvals from all relevant rights holders.
9.6 At events, photographic and audio recordings may be made for reporting and public relations purposes. The specific purposes, legal bases, recipients, and rights of those affected are explained in the separate privacy policy or a notice posted at the event venue. This clause does not replace any required consent.
10. Liability
10.1 RingSpirit Events is fully liable for intent and gross negligence, as well as for damages resulting from the injury to life, body or health that is based on a culpable breach of duty, and in cases of legally mandatory liability.
10.2 In the event of slight negligence resulting in a breach of an essential contractual obligation, RingSpirit Events shall be liable only for the foreseeable, typical damage that was foreseeable at the time the contract was concluded. Essential contractual obligations are obligations whose fulfillment only enables the proper execution of the contract and the customer may regularly rely on their observance.
10.3 Furthermore, liability for damage caused by slight negligence is excluded, insofar as permitted by law. The above provisions apply accordingly to legal representatives and vicarious agents.

Personal data is processed in accordance with applicable data protection regulations, in particular for the initiation of a contract and the performance of the contract, as well as for compliance with legal obligations.
12.2 Details regarding the purposes, legal bases, recipients, storage duration, and rights of the data subject are provided in the separate privacy notices made available during booking and accessible for https://schwalbenschwanz-lounge.com/datenschutz/ review. Where consent is required for individual processing, this is obtained separately. Consent to these ATGB does not constitute data protection consent.
13. Final provisions
13.1 German law applies, subject to mandatory consumer protection regulations of the state in which the consumer has their habitual residence.
13.2 The legal jurisdiction applies. Binding statutory jurisdiction provisions in favor of consumers remain unaffected.
13.3 Changes to this ATGB apply only to contracts that have already been concluded, insofar as they are effectively agreed upon or legally permissible. A mere silence on the part of the customer does not automatically constitute consent.
13.4 If a provision is invalid, the remaining provisions remain valid within the framework of the legal regulations. The legal regulations take the place of provisions that are invalid.
